These terms govern the use of baqueiro.es and set the framework for contracted services when they are provided before acceptance and validly incorporated into the contract. Browsing or sending an enquiry does not amount to entering into a contract. The client’s mandatory rights prevail over any incompatible term.

## 2. Use of the website

Users must respect the law, the security of the website and the rights of third parties. It is not permitted to introduce harmful code, gain unauthorized access, impersonate others or use forms for unlawful communications. Proportionate measures may be taken to contain abuse, without restricting legally recognized rights.

## 3. Services and proposals

Baqueiro offers web development and design, programming, automation, integrations, e-commerce solutions, consulting, SEO and maintenance. Each engagement is defined in a proposal or contract that sets out the scope, deliverables, price, taxes, payments, timelines, client collaboration, support and, where applicable, third-party licenses or services.

The proposal will state its validity period and how it can be accepted. Before accepting, the client may ask for clarification or correct errors. A contract requires express acceptance through the agreed means; a copy or confirmation will be provided on a durable medium, for example by email. Specific terms cannot reduce mandatory consumer protection.

## 4. Price and payment

The quote will state the price and the applicable tax treatment. If the client is a consumer, they will be informed of the total price, including taxes and charges, before contracting; if it cannot be calculated in advance, the method of calculation will be explained. No additional work or recurring services will be charged without prior acceptance. Deposits, milestones and due dates will be specified in the proposal.

## 5. Performance and collaboration

Timelines will depend on the scope and on the dependencies stated in the contract. The client will provide content and access through appropriate channels and must hold the necessary rights to any material they supply. Changes in scope and their financial or time implications will be agreed before they are carried out. Issues affecting deliveries will be communicated and handled in accordance with the contract and the law.

## 6. Deliverables, licenses and maintenance

The proposal will specify the rights of use or assignments over developments, designs and content, their limits, and the conditions for delivering code and credentials. Third-party and open-source components keep their own licenses. Ownership of pre-existing components is not deemed transferred merely by access to the site.

Maintenance, hosting, domains, paid licenses, backups and ongoing support must be expressly included in the contracted service. Any renewal, duration or cancellation mechanism will be disclosed before contracting, with no unauthorized renewals or charges. Applicable legal conformity obligations remain in force.

## 7. Consumer clients and right of withdrawal

If you contract as a consumer at a distance, you have, subject to the applicable legal exceptions, 14 calendar days from the conclusion of the service contract to withdraw without giving any reason. You can notify this to [contacto@baqueiro.es](mailto:contacto@baqueiro.es) or to the provider’s address by means of an unequivocal statement. You may use the model in the next section, although it is not mandatory.

If you expressly request that the service begin during that period and then withdraw, you will only pay the proportionate part already provided, provided the legally required information and request conditions have been met. The right is only lost once the service has been fully performed, with the prior express consent and acknowledgment of that consequence required by law. The fact that a development is customized does not automatically remove the right of withdrawal from a service.

For digital content not supplied on a tangible medium, loss of the right requires the specific conditions of article 103.m of the consolidated text of the Spanish General Law for the Protection of Consumers and Users, including the legally required confirmation. Where a refund is due, it will be made within 14 calendar days of the notification, using the same means of payment unless expressly agreed otherwise at no cost.

## 8. Model withdrawal form

To: Francisco de Assis dos Santos Baqueiro (Baqueiro Desarrollo Web); PO 032, Lugar Parada, 36820 Ponte Caldelas, Pontevedra, Spain; contacto@baqueiro.es.

I hereby give notice that I withdraw from the contract for the following service: __________.
Date of contract: __________.
Name of consumer: __________.
Address: __________.
Date of notice: __________.
Signature, only if submitted on paper: __________.

## 9. Issues, cancellation and liability

The client may report issues using the provider’s contact details. They will be handled in accordance with the contract and the applicable legal remedies. Cancellations other than the legal right of withdrawal will be settled according to the accepted terms and the regulations, with no disproportionate penalties or automatic loss of deposits.

Services will be performed with the professional diligence required. Commercial estimates of traffic, rankings or sales do not replace expressly agreed commitments or rights arising from applicable advertising. Liability for breach and mandatory warranties or rights are not excluded.

## 10. Project data and confidentiality

The parties will protect confidential information received and use it only for the engagement. If Baqueiro accesses personal data on the client’s behalf, the agreement required by article 28 GDPR must be signed before access, including instructions, security measures, sub-processors and rules for return or deletion. The [Privacy policy](/en/privacy-policy/) governs the processing carried out by Baqueiro as controller.

## 11. Complaints and applicable law

You can submit complaints to [contacto@baqueiro.es](mailto:contacto@baqueiro.es), by phone or at the address given. Proof of the complaint will be provided and it will be answered within the applicable legal period. Where a consumer complaint is not resolved satisfactorily, the required information will be provided about the competent alternative dispute resolution bodies and the provider’s participation in that procedure, as appropriate.

Spanish law applies, without depriving consumers of the mandatory protection they are entitled to under the applicable conflict-of-law rules. The competent courts are determined by current legislation. No general waiver of the consumer’s forum is imposed.

## 12. Changes and validity

Changes will be identified with their date and will apply to new contracts once validly incorporated. Existing contracts will be amended by agreement or in the cases permitted by law, with the corresponding information and rights. If a provision is found to be invalid, the relevant legal regime will apply to the rest of the contract, without replacing it with an equivalent restriction contrary to the law.
